BMI and the Radio Music License Committee (RMLC) have announced that they have solidified terms of a settlement agreement concerning the fees payable by the U.S. commercial radio industry to publicly perform the more than 7.5 million musical works in the BMI repertoire through 2016. The RMLC represents the vast majority of the nation’s radio stations. The settlement, which will require Federal Court approval, would bring an end to the two-and-a-half years of litigation between the parties.

The new BMI license covers the period January 1, 2010 through December 31, 2016. In broad terms, it features a return to a percentage-of-revenue fee structure and addresses the range of new media platforms in which the radio industry is increasingly engaged. More specifically, the new license entails:

  • A $70.5 million industry fee credit against 2010-2011 industry payments;
  • A 1.7%-of-gross-revenue fee structure (with simplified revenue reporting) for stations on the blanket music format license, less a standard deduction of 12% for revenue derived from terrestrial/analog and HD multicasting broadcasts and a 25% deduction for revenue attributable to new media uses;
  • Retention of the program-period license that benefits many talk-format stations, with a base fee of 0.2958% of gross revenue, less the same deductions noted above; and
  • Expanded rights coverage to accommodate the industry’s developing new media platforms related to Internet websites, smart phones and other wireless devices.

The impact of this settlement will be reflected immediately with BMI’s June 2012 billing statements. The practical effect of the $70.5 million credit adjustment is that many stations will have a BMI credit balance available for the remainder of this year. The new BMI license forms will be made available to stations following Federal Court approval of the settlement.  (6/11)

The CMB Board has proposed opening as many as two “member-at-large” board seats to non-radio professionals for nomination to the Board. This following its reaffirmation for Christian music broadcasters to develop and nurture relationships between radio and those businesses and organizations that service radio and its work. This reassertion comes after months of uncertainty and possible misperceptions regarding CMB’s position on such matters, especially regarding relationships with the music industry. Neither CMB nor its Board has had any official position or statement on how radio stations are serviced by the music industry, except to affirm what is allowable by law and each individual station’s own policy exercised within the law.

“In any lasting relationship there will be moments of conflict. Our hope is that when there is conflict, it will draw us together to work on mutually agreeable solutions, not tear us apart,” says Chris Lemke, Board Chair and Executive Director of CMB. “CMB’s role is to engage people, not to legislate policy. If and when then arises a matter requiring a definitive position, CMB will diligently work toward that which best represents its entire membership of people.”

The Board will vote within the next month to amend the bylaws and the acceptance of this proposal.  (5/22)

KNWI/Des Moines (Life 107.1) names Dan Raymond as the new Program Director/Mornings.  The move keeps Dan in the Northwestern Media family where he’s been the past 7 years and sends him back to Iowa from MN where he has served as Operations Director at KDNW/Duluth (Life 97.3).  KNWI station manager Dave St. John says “Dan comes into this position running. His experience and track record in Northwestern Media exemplifies an empowered Program Director who wants to craft and implement a local strategy that helps the station grow and reach people for Christ here in our community.”

Prior to KDNW/ Duluth Dan was PD at KNWS/Waterloo (Life 101.9).  “Having spent 14 of the past 15 years in Iowa (with 8 years in central Iowa), it’s been amazing seeing Life 107.1  start from scratch- and grow incredibly to reach more and more people.   I follow in the footsteps of great leadership, and am thrilled to be able to join the Life 107.1 team for this next chapter of their (our!) adventure,” said Raymond.  His first day at the new Monday June 18th.   (5/15)

CMB Members are invited to its fifth teleconference May 16th, at 11:00AM CDT / 12:00 noon ET. Members will benefit from this “working lunch” as we’ll hear from KSBJ/Houston Production Director Sterling Tarrant with "How do you get your listeners to 'delight' in your messages?"  In a PPM world, we’re told that messages should be shorter and shorter, but if you were to take that to its logical conclusion it would mean that you should stop doing anything that interrupts the music. Since that is impractical, Sterling Tarrant, Production Director at KSBJ, suggests we should look at a different standard, and that is this: “How do you get your listeners to ‘delight’ in your messages.” Sterling will share some of his latest copywriting and production techniques that are helping to achieve over 6.5 hours of AWTE, and the second highest 6+ share in all of Christian radio. The conference will last 45 minutes with an opportunity for questions at the end of the session.  (5/14)

MainstreamNetwork, a subsidiary of ChristianNetcast.com has announced their acquisition of StreamAudio, a streaming service provider based in Tacoma, WA. The merger provides a wider array of services and stronger infrastructure to clients joining MainstreamNetwork.  “ChristianNetcast and StreamAudio will be merging their player box technologies to form one of the most advanced player boxes in the industry today,” said David Palmer, ChristianNetcast Vice-President of Sales and Marketing.  “Perhaps best of all,” he continued, “MainstreamNetwork and ChristianNetcast customers will now have access to StreamAudio’s royalty reporting tool.  This royalty reporting tool works together with all automation software to provide comprehensive data for all types of royalty reports.”

The purchase of StreamAudio marks the third such acquisition in the last three years by ChristianNetcast.com (CNC), the parent company of MainstreamNetwork.  “This was an ideal situation for us to broaden our customer base and continue to grow,” said Palmer.  In April 2009, CNC purchased NWR Network (NWR) of Colorado Springs and in 2011 they acquired Barnabas Road Media (BRM) of Indianapolis. As the parent company, CNC now owns and operates MainstreamNetwork, BRM, NWR, and StreamAudio.

“We have seen growth in a very difficult economy and feel very blessed to continue to grow the company through acquisitions like StreamAudio where we are continuously adding new customers to existing companies,” said Palmer.  “The StreamAudio acquisition fits perfectly into our marketing plans for MainstreamNetwork.”

Evolving technology allows streaming to continue through the acquisition with no interruption in service.  Todd VanTasel, MainstreamNetwork Vice-President of Technology explained, “for former StreamAudio customers, the transition will require no action whatsoever and will be unnoticeable for listeners."  VanTasel also stated that the ChristianNetcast.com infrastructure has made many advances that will be of great benefit to new MainstreamNetwork customers. “StreamAudio clients will continue to have access to the many features they have enjoyed and will now be able to benefit from the many improved technologies that MainstreamNetwork offers to provide a comprehensive streaming service.”

In June of 2010 MainstreamNetwork launched its own iPhone app on the Apple iStore. The app can be used to listen to the streaming companies stations on an iPhone, iPod Touch or the new iPad. VanTasel’s primary focus these days is to address the growing need for customers ever changing platforms. "We have an obligation to our customers and their listeners to lead the way with technology and developing services valuable to our customers," stated VanTasel. "Developing our own app that would be available for download from the Apple iStore became a top priority for us."

The expansion and growth of MainstreamNetwork in the last few years is unprecedented in the streaming industry.  “By staying out ahead of emerging technology, we’ve strategically positioned ourselves to take advantage of growth opportunities,” Palmer explained.  “Expanding a business is always tricky, but to be able to accomplish this kind of rapid growth in a still recovering economy is a credit to our customer service and our client loyalty.”  When asked about further acquisitions, Palmer replied, “We’re continuously looking at new opportunities and are committed to keeping ourselves in a position to expand further.”  For more information on MainstreamNetwork and its services, visit www.MainstreamNetwork.com, or call toll-free (866) 7-STREAM.  (5/2)
